Big Fish Social Casino Targeted by New Class Action Lawsuit in Washington State

Seattle-based social casino Big Fish is facing a fresh class-action lawsuit that accuses it of operating “illegal online casino games.”
The play-money site was hit by several similar lawsuits last year after a federal court in Seattle ruled that the virtual chips used in Big Fish’s casino games could be considered to be “something of value,” which meant they could be defined as gambling under Washington State law.
The state defines gambling as “risking something of value on the outcome of a contest of chance or a future contingent event not under the person’s control or influence to receive something of value in the event of a certain outcome.”
Big Fish to Fry?
The new suit names Big Fish’s former owner, Churchill Downs, and new owner, Aristocrat Technologies, as defendants. The social games developer was acquired by Australian slots manufacturer Aristocrat in January 2018 — three months before the court’s ruling — for almost $1 billion.
While Big Fish’s games are ostensibly free to play, extra chips can be acquired through in-app purchases.
Curiously, the new lawsuit accuses Big Fish of using practices similar to casinos to reap “huge profits” while never paying out anything of monetary value — an accusation that appears to be self-defeating, since the virtual chips players win must have “value” in order to be considered gambling.
As we allege in our complaint, the mobile gambling industry, by design, preys on consumers by bringing additive gambling opportunities directly into their homes,” Christopher Dore, an attorney representing the plaintiff, Florida resident Manasa Thimmegowda, told Komo News.
“We look forward to proving that companies are aware that many of their customers fall victim to these gambling games, with significant negative impacts on their lives financially and otherwise.”
Appeal Expected
The original case against Big Fish was brought in 2015 by former player Cheryl Kater, who claimed she had spent $1,000 topping up chips on the site. She argued Big Fish violated several Washington State statutes, including the Recovery of Money Lost at Gambling Act and the Washington Consumer Protection Act.
The case was tossed in 2016, but Kater appealed. The resulting verdict was a shock to the social gaming industry and could have ramifications not just for social casinos but for any game that employs microtransactions and an element of chance.
In April last year, Aristocrat vowed to work with Churchill Downs to appeal the verdict, emphasizing there were “meritorious legal and factual defenses against [Kater’s] allegations and requests for relief.”

I have been a victim of this game for 10 years and have spent way to much purchasing chips. The original owners were awesome, however once Churchill took over it was a disaster. Unfortunately I still played because I’ve met a lot of nice people on there and the games are fun. When you purchase chips then the games get tighter and tighter till you loose everything. Years ago you could play for hours on 5mil chips but not now they take it away in seconds I want to be part of this class action suit. Why weren’t we all notified? Aren’t they supposed to send all people involved with this company a letter? I never received a thing. Frustrating
They won't even thankyou for spending massive amounts of money... its a joke...they take and work their bs on anyone!!

I would get In on this lawsuit. I have lost plenty with BF casino and can prove it. I have been praying they would be shut down. There are certain medications that make a person prone to gambling and I take one of them. These sites are very bad for that situation.
I spent over $5000 within a month or two on this game July 2019 to Aug 2019. Can I recoup any funds? These games have destroyed me financially. This and Billionaire Casino which i spent probably around $10k.
Big Fish is nothing but a scam! They sell you fake chips for real money and they Write the Program to where you win just enough to get you in then you lose it all then you start to buy then they encourage their VIP Tiers on how you get special treatment on special Tiers. Well they fail to tell you they expect you to drop a butt load of money constantly and consistently or they start their BULLY MOVES!!!!! I have made it to VIP TIER 15 and that’s hundreds of thousands of dollars and they expect you to continue spending hundreds of thousands of dollars on FAKE CHIPS SO THEY EDIT YOUR PROGRAM to lose, lose, lose, lose and lose then they start cutting the comp chips from you, the begin the BULLY CYCLE!!! Have proof in black and white where the literally BULLY ME AND THREATENED ME ABOUT CERTAIN THINGS!! They cut me off my comp chips and tell me to think about it!!! BULLY CYCLE 2 started!!! It's a strange coincidence how forums regarding Big Fish Casino grievances always contain a dismissive and adversary-like comment. It’s unclear what stake they hold in this matter if they don’t spend money on this game. Some people have suffered enormous social and financial consequences from using this app. Designing their games to be addictive makes them more money. For people who have a gambling addiction, Big Fish Casino is the dealer that lives in your home. It’s also a strange coincidence that Big Fish Casino released three new slots immediately after COVID-19 stimulus checks were announced. One could only wonder why legitimate casinos are not concerned about the potential loss of revenue from Big Fish Casino. Probably sooner rather than later, individuals who’ve spent money on the app may seek compensation, especially considering the fact that many will struggle financially for years while the economy recovers from the COVID-19 pandemic.

TO EVERYONE CRYING ABOUT THEIR HARD EARNED MONEY: You gave your own money away! Big Fish did not take anything from you. You WILLINGLY and KNOWINGLY purchased virtual items from them. You entered your credit card info in and made a PURCHASE. You CHOSE to buy FAKE CHIPS. Big Fish did not deceive you about what you were buying. It’s called “gambling” for a reason — you might not win. You can’t demand your money back when you lose it all at a real casino. Why would you think you would be allowed to at a fake casino? If you’re crying over the fact that you wasted your own hard earned money on this FAKE GAME, it shows that you are not the brightest. You could have scrolled past the Big Fish app but instead you downloaded it, created an account, gave them your credit card info, and proceeded to buy stuff. That is all on YOU, not on Big Fish. No employee from Big Fish was sitting in your house with a gun to your head, forcing you to make a purchase. That was YOU deciding to buy on your own. It is maddening to hear you cry about it now and try to blame it on someone else. What do you do when you pay for a ticket to go see a movie and you end up not liking it? Do you whine and cry about it and go try to sue the movie theatre? Uhh, no, of course you don’t. Because that would be IDIOTIC.
I Stopped playing Big Fish after spending thousands as soon as they asked me to agree to new terms last year. Please add me to the lawsuit!
I want to also sue BF took too much money from me without ever giving me a serious chance of winning. It’s obvious they designed the games to be addictive. And use other tricks to make you buy more chips. You want to add me to the law suit. That would be wonderful.
